Legal Services

At Mashamaite MR Attorneys Incorporated, our attorneys understand that people want to work with a law firm possessing exceptional knowledge and experience in most legal matters.
We offer a comprehensive range of legal services from estate administration and civil litigation to assistance in claiming from the road accident fund.

Our firm has in most cases represented individual clients against well-established (private and public) institutions represented by what is commonly referred to as ‘BIG LAW FIRMS’ in the legal circles.

Estate Administration

The administration of an estate refers to the management and distribution of a deceased person’s estate. The Administration of Estates Act 66 of 1965 and the Intestate Succession Act 81 of 1987 regulates this. We are fully acquainted with these requirements and the internal procedures of the office of the Master of the High Court.

Where the registered owner of immoveable property has died his/her property will need to be transferred to another person; normally a family member. The property will often need to be transferred to an heir or beneficiary nominated in the Will of the deceased, but sometimes it may be in terms of the Intestate Succession Act.

This can be a complex process, and is best handled by experienced attorneys.

Road Accident Fund Claims

A percentage of all petrol and diesel purchased in South Africa is used to finance the Road Accident Fund, which is a government run insurance scheme. This fund compensates those who are seriously injured in road accidents that they weren’t solely responsible for causing.

Victims of road accidents can claim for medical expenses, loss of earnings and, in cases where serious injury occurs, damages for pain and suffering.

We have the knowledge and experience to assist you and to ensure that your claim is properly calculated and submitted to the Road Accident Fund.

Matrimonial & Family Law

Family law or matrimonial law incorporates family matters and domestic relationships such as marriage and civil unions, divorce and annulment, child custody and the best interests of the child, maintenance, child abuse and domestic violence.

We offer a high level of service and expertise with an understanding and sensitive approach, taking into account each client’s needs, while proceeding promptly with legal action when necessary. We are always committed to achieving the best possible outcome for you.

Debt collection

We can assist with the recovery of all monies due, owing and payable to our clients by means of traditional debt collecting procedures, or the institution of litigation proceedings, if necessary.

When handling these services, our team ensures that measures are taken to protect clients’ reputations while taking into account the requirements and positions of their businesses when collecting from non-compliant debtors.

Labour & Employment Law
